Terms and Conditions
These Terms and Conditions (“Terms”) govern your use of votatec.ca and any purchases you make from Votatec. By using our site, creating an account, or placing an order, you agree to these Terms. If you don’t agree, please don’t use the site.

1. Who We Are
Votatec is a Canadian LED lighting manufacturer and wholesale distributor based in Ontario. When these Terms say “we”, “us”, or “our”, they refer to Votatec. When they say “you” or “your”, they refer to you as a user or customer.

2. Who Can Use Our Site
This site is built for business buyers. You may use it if:
- You’re at least 18 years old
- You’re buying on behalf of a business, contractor, reseller, or government body
- You have the legal authority to bind that business to these Terms
- You’re not prohibited from doing business under Canadian law
We don’t sell to consumers for personal use. If that’s what you need, we’ll refer you to a local distributor.
3. Your Account
To place orders or request quotes, you’ll need an account. When you register, you agree to:
- Give us accurate, complete, and current information
- Keep your password secure
- Take responsibility for all activity under your account
- Notify us right away if you suspect unauthorised use
We can suspend or close accounts that break these Terms, submit false information, or stay inactive for long periods.
4. Product Information
We work hard to keep product details accurate, but we can’t guarantee every specification, image, or description is error-free. Actual products may vary slightly from photos due to:
- Screen colour differences
- Lot-to-lot manufacturing variations
- Product improvements and revisions
- Third-party data from suppliers
Technical specs (wattage, lumens, CCT, IP rating) follow published manufacturer data at the time of listing. Always verify critical specs before ordering for a specific project.
5. Quotes and Orders
How quotes work
Prices on request forms or emailed quotes are valid for 30 days unless stated otherwise. A quote isn’t a binding offer. We confirm your order once we accept it in writing (email or order acknowledgement).
Order acceptance
We reserve the right to:
- Decline any order at our discretion
- Limit quantities per customer, per product, or per region
- Cancel orders with pricing or availability errors
- Verify payment and credit before processing
If we cancel an order after payment, we’ll refund you in full.
Pricing errors
If a product is listed at an obviously wrong price (typo, system glitch, rounding error), we aren’t obligated to honour it. We’ll contact you to confirm the correct price or cancel the order.
6. Pricing and Payment
Currency
All prices are in Canadian Dollars (CAD) unless we confirm otherwise in writing.
Taxes
Prices exclude applicable taxes (GST, HST, PST, QST) unless stated. Canadian tax is added at checkout based on your delivery address.
Payment methods
We accept:
- Credit card (Visa, Mastercard, American Express)
- E-transfer
- Wire transfer (for larger orders)
- Net 30 terms (for approved business accounts only, subject to credit check)
Late payments
Accounts on approved credit terms past due over 30 days are subject to:
- Interest at 2% per month (24% annual)
- Suspension of further shipments
- Collection fees and legal costs where applicable
Price changes
We can change prices anytime without notice. Changes don’t affect orders already confirmed.
7. Shipping and Delivery
Shipping methods
We ship across Canada via standard freight and courier. Shipping costs, carriers, and timelines depend on order size, weight, and destination. We’ll confirm shipping details on your order acknowledgement.
Delivery times
Delivery estimates are approximate. We aren’t liable for delays caused by:
- Carrier disruptions or weather
- Customs or regulatory holds
- Supplier backorders
- Events beyond our reasonable control
Inspection on delivery
You must inspect goods within 5 business days of delivery. Report any shortages, damage, or errors in writing to Info@votatec.ca within that window. Claims made after 5 business days may not be accepted.
8. Risk of Loss and Title
Risk of loss passes to you when the carrier takes possession of the goods at our warehouse (FOB origin). Title passes to you when we receive full payment. Until then, we retain a security interest in the goods.
9. Returns and Refunds
Returns are accepted only for defective products or shipping errors, subject to our separate Returns Policy. Custom orders, special-order items, and products installed or modified aren’t returnable. Contact Info@votatec.ca within 5 business days of delivery to start a return.
10. Product Warranty
Our products are covered by the original manufacturer’s warranty. Warranty periods and terms vary by product. CSA-certified products meet Canadian electrical standards at time of manufacture.
We don’t provide additional warranties beyond what the manufacturer offers. EXCEPT AS REQUIRED BY LAW, ALL PRODUCTS ARE SOLD “AS IS” AND WE DISCLAIM ALL OTHER WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
To claim warranty, contact us with:
- Original invoice or order number
- Photos or video of the defect
- Installation details (if applicable)
11. Installation and Use
You’re responsible for proper installation by a qualified electrician in line with local codes, the Canadian Electrical Code, and the manufacturer’s instructions. Improper installation voids the warranty and may cause damage or injury.
We aren’t liable for installation costs, removal costs, or any loss caused by improper installation.
12. Limitation of Liability
TO THE MAXIMUM EXTENT ALLOWED BY LAW, VOTATEC’S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THESE TERMS, YOUR ORDER, OR OUR PRODUCTS IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT IN QUESTION.
We aren’t liable for:
- Indirect, incidental, or consequential damages
- Lost profits, revenue, or business opportunities
- Loss of data or reputation
- Third-party claims
This limitation applies whether the claim is based on contract, tort, negligence, or any other theory.
13. Indemnification
You agree to defend, indemnify, and hold Votatec harmless from any claim, loss, or cost (including legal fees) arising from:
- Your breach of these Terms
- Your misuse of our site or products
- Your violation of any law or third-party right
- Improper installation or use of our products
14. Intellectual Property
All content on votatec.ca (text, images, logos, product specs, videos, code) is owned by Votatec or our licensors and protected by Canadian and international copyright and trademark law.
You may:
- View content for legitimate business purposes
- Print product pages for internal review
- Share links to our site
You may not:
- Copy, modify, or republish content without written permission
- Use our trademarks or logos without authorisation
- Scrape, crawl, or extract data automatically
- Frame our site within another
15. Prohibited Uses
You agree not to:
- Use the site for any illegal purpose
- Submit false, misleading, or fraudulent information
- Interfere with site security or availability
- Upload malware or attempt unauthorised access
- Use bots, scrapers, or automated tools without permission
- Resell or redistribute products in violation of any territorial restriction
- Impersonate another person or business
We reserve the right to investigate and take action, including legal action, for any violation.
16. Third-Party Content and Links
Our site may link to third-party websites, product data sheets, or resources. We don’t control those sites and aren’t responsible for their content, accuracy, or practices. Visit at your own risk.
17. Privacy
Your use of the site is also governed by our Privacy Policy, which explains how we collect and handle personal information.
18. Account Termination
We can suspend or close your account anytime, with or without notice, for any reason including:
- Breach of these Terms
- Non-payment
- Fraud or misuse
- Inactivity
- Business or legal reasons
You can close your account by emailing Info@votatec.ca. Outstanding invoices and obligations survive account closure.
19. Force Majeure
We aren’t liable for failure to perform due to events beyond our reasonable control, including natural disasters, pandemics, strikes, supply chain disruptions, war, government actions, or utility failures.
20. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any dispute arising from these Terms or your use of the site will be resolved exclusively in the courts of Ontario, Canada. You consent to the jurisdiction of those courts.
The United Nations Convention on Contracts for the International Sale of Goods doesn’t apply.
21. Dispute Resolution
Before starting legal action, please contact us at Info@votatec.ca to try to resolve the issue informally. We aim to respond within 10 business days.
If we can’t resolve it, either party may pursue mediation or court action in Ontario as described above.
22. Severability
If any part of these Terms is found invalid or unenforceable, the rest remains in effect.
23. No Waiver
Our failure to enforce any part of these Terms doesn’t waive our right to enforce it later.
24. Assignment
You can’t assign or transfer your rights under these Terms without our written consent. We can assign our rights to an affiliate or successor, including in a merger or acquisition.
25. Entire Agreement
These Terms, together with our Privacy Policy and any order confirmations, form the entire agreement between you and Votatec about the subject matter covered. They replace any prior discussions or agreements.
26. Changes to These Terms
We can update these Terms anytime. The updated version takes effect when posted, with a new “Last Updated” date. For material changes, we’ll notify account holders by email or site notice. Continued use of the site after changes means you accept them.
